Article R2191-11 of the French Public procurement code

Repayment of the advance is deducted from the sums due to the contractor, at a rate and in accordance with the procedures laid down in the terms of the contract, by deduction from the sums due by way of instalments, final partial payment or balance.

If the contract is silent, the advance is repaid in instalments, taking into account the amount of the advance granted and the sums still due to the contractor. This reimbursement is deducted from the sums due to the contractor and begins :

1° For advances less than or equal to 30% of the amount of the contract inclusive of all taxes, when the amount of the services performed reaches 65% of the amount of the contract inclusive of all taxes;

2° For advances in excess of 30% of the amount of the contract including all taxes, on the first request for payment.

Le remboursement de l’avance s’impute sur les sommes dues au titulaire, selon un rythme et des modalités fixées par les clauses du marché par précompte sur les sommes dues à titre d’acomptes, de règlement partiel définitif ou de solde.

Dans le silence du marché, le remboursement de l’avance est échelonné en tenant compte du montant de l’avance accordée et des sommes restant dues au titulaire. Ce remboursement s’impute par précompte sur les sommes dues au titulaire et débute :

1° Pour les avances inférieures ou égales à 30 % du montant toutes taxes comprises du marché, quand le montant des prestations exécutées atteint 65 % du montant toutes taxes comprises du marché ;

2° Pour les avances supérieures à 30 % du montant toutes taxes comprises du marché, à la première demande de paiement.
