Article R2191-19 of the French Public procurement code

When the amount of the advance payment is less than 80% of the amount calculated in accordance with the provisions of articles R. 2191-16 to R. 2191-18, the reimbursement of the advance payment must be completed when the amount of the services performed by the contractor reaches 80% of the amount, including all taxes, of the services entrusted to him under :

1° Of the purchase order in the case of a framework agreement with purchase orders that does not include a minimum fixed in terms of value ;

2° Of the minimum amount in the case of a framework agreement with purchase orders including a minimum amount fixed in terms of value.

In other cases, if the contract is silent, the advance is reimbursed in full when the amount of the services provided, including all taxes, reaches the amount of the advance granted.

Article R2191-19

Lorsque le montant de l’avance est inférieur à 80 % du montant calculé conformément aux dispositions des articles R. 2191-16 à R. 2191-18, le remboursement de l’avance doit être terminé lorsque le montant des prestations exécutées par le titulaire atteint 80 % du montant toutes taxes comprises des prestations qui lui sont confiées au titre :

1° Du bon de commande dans le cas d’un accord-cadre à bons de commande ne comportant pas de minimum fixé en valeur ;

2° Du montant minimum dans le cas d’un accord-cadre à bons de commandes comportant un montant minimum fixé en valeur.

Dans les autres cas, dans le silence du marché, l’avance est intégralement remboursée lorsque le montant toutes taxes comprises des prestations exécutées atteint le montant de l’avance accordée.
