Article R2196-12 of the French Public procurement code

All civil servants or agents who have knowledge in any capacity whatsoever of information gathered about undertakings pursuant to this section shall be bound by professional secrecy and, where applicable, by the rules relating to the protection of defence secrecy.
The information gathered may not be used for any purpose other than to check the cost of the contract under review or any other similar contract.

Tous les fonctionnaires ou agents qui ont connaissance à un titre quelconque des renseignements recueillis au sujet des entreprises en application de la présente section sont astreints au secret professionnel ainsi que, le cas échéant, aux règles relatives à la protection du secret en matière de défense.
Les renseignements recueillis ne peuvent être utilisés à des fins autres que le contrôle du coût de revient du marché soumis au contrôle ou de tout autre marché analogue.
