Article R221-81 of the French Monetary and Financial Code

When, pursuant to the second paragraph of article L. 221-26, the competent administrative authority intends to penalise an infringement of the rules laid down by this article by forfeiting the interest on the passbook, it shall notify this intention, stating the reasons, by registered letter with acknowledgement of receipt to the holder of the youth passbook concerned and, where applicable, to his legal representative, in such a way as to allow the interested party, within a period of thirty days, either to make his observations known or to indicate his acceptance. If the competent administrative authority rejects these comments, it must give reasons for its decision.

The establishments and bodies concerned by this procedure are kept informed by the competent administrative authority which, to this end, sends them copies of its correspondence and decisions.

Lorsqu’en application du deuxième alinéa de l’article L. 221-26, l’autorité administrative compétente envisage de sanctionner une infraction aux règles fixées par cet article par la perte des intérêts du livret, elle notifie cette intention en indiquant le motif, par lettre recommandée avec demande d’avis de réception au titulaire du livret jeune concerné et, le cas échéant, à son représentant légal de manière à permettre à l’intéressé, dans un délai de trente jours, soit de formuler ses observations, soit de faire connaître son acceptation. Lorsque l’autorité administrative compétente écarte ces observations, sa décision doit être motivée.

Les établissements et organismes concernés par cette procédure sont tenus informés par l’autorité administrative compétente qui, à cet effet, leur adresse copie de ses correspondances et de ses décisions.
