Article R2222-2 of the French Public procurement code

When the purchaser decides to implement the provisions of article L. 2213-6, the invitation to tender or, failing this, the consultation documents must state that the State, local authorities or other public bodies will contribute to the financing of the investment in the form of a minority shareholding in the capital of the contractor and must specify the main characteristics of the project company to be set up.

Lorsque l’acheteur décide de mettre en œuvre les dispositions de l’article L. 2213-6, l’avis d’appel à la concurrence, ou à défaut, les documents de la consultation mentionnent que le concours de l’Etat, des collectivités territoriales ou d’autres personnes publiques au financement des investissements prend la forme d’une participation minoritaire au capital du titulaire et précise les principales caractéristiques de la société de projet à constituer.
