Article R2272-17 of the French Labour Code

The opinions issued by the sub-committees defined in article R. 2272-10 are valid if more than half or, for the sub-committees mentioned in 4° and 6° of this article, if more than one third of the members with voting rights are present, including the members taking part in the debates, either by means of a telephone or audiovisual conference or by electronic consultation, or have given a mandate.

If the quorum is not reached, the sub-committees shall deliberate validly without a quorum being required following a new notice of meeting with the same agenda and specifying that no quorum will be required.

Les avis émis par les sous-commissions définies à l’article R. 2272-10 le sont valablement si plus de la moitié ou, pour les sous-commissions mentionnées aux 4° et 6° de cet article, si plus du tiers des membres ayant voix délibérative sont présents, y compris les membres prenant part aux débats, soit au moyen d’une conférence téléphonique ou audiovisuelle soit par voie de consultation électronique, ou ont donné mandat.


Lorsque le quorum n’est pas atteint, les sous-commissions délibèrent valablement sans condition de quorum après une nouvelle convocation portant sur le même ordre du jour et spécifiant qu’aucun quorum ne sera exigé.
