Article R228-83 of the French Commercial code

Release of registrations shall be made by the representatives of the group of bondholders concerned.

Except in the cases provided for in the contract of issue, the representatives of the group of bondholders may release the registrations, even without noting the repayment of the loan, if they have been authorised to do so by a decision of the general meeting of bondholders.

Except in the case provided for in the preceding paragraph, the total or partial release of the registrations may only be given by the representatives of the masse, in the event of repayment or payment into their hands of the full disposal price of the assets to be released.

The representatives of the masse are not obliged to give partial release of the guarantees in the event of normal amortisation by drawing lots or redemption of the bonds.

Article R228-83

La mainlevée des inscriptions émane des représentants de la masse intéressée.

Hors les cas prévus au contrat d’émission, les représentants de la masse peuvent donner mainlevée des inscriptions, même sans constatation du remboursement de l’emprunt, s’ils ont été habilités à cet effet par une décision de l’assemblée générale des obligataires.

Hors le cas prévu à l’alinéa précédent, la mainlevée totale ou partielle des inscriptions ne peut être donnée par les représentants de la masse, qu’au cas de remboursement ou de versement entre leurs mains de l’intégralité du prix d’aliénation des biens à dégrever.

Les représentants de la masse ne sont pas tenus de donner mainlevée partielle des garanties en cas d’amortissement normal par tirage au sort ou rachat des obligations.
