In order to establish whether the national mentioned in the first paragraph of article L. 233-1, and articles L. 233-2 and L. 233-3 represents a danger to public order or public security, the Prefect may, if he deems it essential and without proceeding systematically, when issuing the registration certificate, ask the authorities of the foreign national’s Member State of origin and, where applicable, other Member States, for information on the criminal record of the person concerned. The authorities thus consulted are given two months in which to respond.
When the Minister for the Interior receives a request from the authorities of a Member State of the European Union concerning the criminal record of a French national, he will send his response within two months.
The Minister for the Interior may also ask the authorities of a Member State of the European Union to provide information on the criminal record of the person concerned.
