Title III: STAY IN FRANCE

The health insurance mentioned in article L. 233-1 must cover the benefits provided for in articles L. 160-8, L. 160-9 and L. 321-1 of the Social Security Code.When required, the adequacy of resources is assessed taking into account the personal situation of the person concerned. In case of doubt, the Prefect may, without systematically doing so, verify that the conditions mentioned in articles L. 233-1, R. 233-7 and R. 233-8 are met.

European Union citizens who have entered France to look for work may not be expelled on the grounds that their residence is irregular as long as they are able to provide proof that they are continuing to look for work and that they have a real chance of being hired.

Without prejudice to the provisions of the third paragraph of article L. 233-4, citizens of the European Union subject to transitional measures by their accession treaty who wish to work in France are required to apply for the issue of a residence permit as well as the work permit provided for in article L. 5221-2 of the Labour Code to work as an employee.

Family members of foreign nationals mentioned in article R. 233-4, citizens of the European Union subject to transitional measures or third-country nationals are also required to apply for the issue of a residence permit as well as the work permit provided for in article L. 5221-2 of the Labour Code in order to work.

European Union citizens subject to transitional measures by their accession treaty who were admitted to the French labour market on the date of their country’s accession to the European Union or subsequently, for an uninterrupted period equal to or greater than twelve months, and who wish to continue in paid employment when their residence permit expires, apply for a new residence permit without work authorisation being required.
