Article R231-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

In order to establish whether the national mentioned in the first paragraph of article L. 233-1, and articles L. 233-2 and L. 233-3 represents a danger to public order or public security, the Prefect may, if he deems it essential and without proceeding systematically, when issuing the registration certificate, ask the authorities of the foreign national’s Member State of origin and, where applicable, other Member States, for information on the criminal record of the person concerned. The authorities thus consulted are given two months in which to respond.
When the Minister for the Interior receives a request from the authorities of a Member State of the European Union concerning the criminal record of a French national, he will send his response within two months.

The Minister for the Interior may also ask the authorities of a Member State of the European Union to provide information on the criminal record of the person concerned.

Aux fins d’établir si le ressortissant mentionné au premier alinéa de l’article L. 233-1, et aux articles L. 233-2 et L. 233-3 représente un danger pour l’ordre public ou la sécurité publique, le préfet peut, s’il le juge indispensable et sans y procéder de façon systématique, lors de la délivrance de l’attestation d’enregistrement, demander aux autorités de l’Etat membre de l’Union européenne d’origine de l’étranger et, éventuellement, à d’autres Etats membres, des renseignements sur les antécédents judiciaires de l’intéressé. Les autorités ainsi consultées bénéficient d’un délai de deux mois pour faire parvenir leur réponse.
Lorsque le ministre de l’intérieur est saisi par les autorités d’un Etat membre de l’Union européenne d’une demande visant les antécédents judiciaires d’un ressortissant français, il transmet sa réponse dans un délai de deux mois.
