Article R2311-12 of the French Public Health Code

If a centre does not meet or ceases to meet the conditions listed in articles R. 2311-7, R. 2311-9 and R. 2311-13, or refuses to submit to the inspection provided for in article R. 2311-10, the president of the departmental council will give it formal notice to comply with the requirements of these articles within a maximum period of three months.

If the injunctions of the president of the departmental council are not complied with, the centre loses its name and, if it has entered into an agreement with the department in application of article L. 2112-4, this agreement is terminated. In the case of centres that are not run by a public authority, the President of the Departmental Council will withdraw approval.

Si un centre ne remplit pas ou cesse de remplir les conditions énumérées aux articles R. 2311-7, R. 2311-9 et R. 2311-13, ou refuse de se soumettre au contrôle prévu par l’article R. 2311-10, le président du conseil départemental le met en demeure de se conformer aux prescriptions de ces articles dans un délai maximum de trois mois.

Dans le cas où il n’a pas été satisfait aux injonctions du président du conseil départemental, le centre perd sa dénomination et, s’il a passé convention avec le département en application de l’article L. 2112-4, cette convention est résiliée. Lorsqu’il s’agit de centres ne relevant pas d’une collectivité publique, le président du conseil départemental procède au retrait de l’agrément.
