When the centre supplies the persons mentioned in article L. 2311-4 with contraceptive medicines, products or objects free of charge, it must enlist the help of a pharmacist registered in section D or E of the national order of pharmacists.
If the centre is part of a health establishment, this pharmacist may be one of the pharmacists in the establishment’s in-house pharmacy, which supplies the centre under the conditions set out in article R. 5126-13.
If there is no pharmacist, the director or another doctor of the centre, designated by name, may be authorised by the Director General of the Regional Health Agency to hold, control and manage contraceptive medicines, products or objects. Silence on the part of the Director General of the Regional Health Agency will be deemed to constitute tacit authorisation on expiry of a period of two months from the date of receipt of the application.
Contraceptive medicines, products or devices are dispensed to the persons mentioned in the first paragraph by a doctor or midwife from the centre, under the conditions set out in Article L. 5134-1.
