Article R2311-9 of the French Public Health Code

The centres must meet the following conditions:

1° Be run by a doctor who is either a qualified specialist or qualified in medical gynaecology, obstetrics or obstetric gynaecology, or who holds a diploma of complementary specialised studies in reproductive medicine and medical gynaecology; if it is not possible to recruit a doctor who meets these conditions, a waiver may be granted by the Director General of the Regional Health Agency to a doctor with specific knowledge of gynaecology and birth control;

2° Have at least one person for their consultations, on a permanent basis, who is competent in marital and family counselling;

3° If the needs of the population so require, be assisted by a midwife, a nurse, a social service assistant and a psychologist;

4° Not include in their management and supervisory staff or in their technical staff any person who has been convicted of acts contrary to honour, probity or morality or of an offence under Title II of Book II of this Part and Chapter IV of Title III of Book IV of Part V of this Code;

5° Comply with the technical conditions for installation and operation laid down by order of the Minister for Health.

Les centres doivent remplir les conditions suivantes :

1° Etre dirigés par un médecin soit spécialiste qualifié ou compétent qualifié en gynécologie médicale, en obstétrique ou en gynécologie-obstétrique, soit titulaire du diplôme d’études spécialisées complémentaires de médecine de la reproduction et gynécologie médicale ; en cas d’impossibilité de recruter un médecin remplissant ces conditions, une dérogation peut être accordée par le directeur général de l’agence régionale de santé à un médecin justifiant de connaissances particulières en gynécologie et en régulation des naissances ;

2° Disposer au minimum pour leurs consultations, et de façon permanente, d’une personne compétente en matière de conseil conjugal et familial ;

3° S’assurer, si les besoins de la population l’exigent, le concours d’une sage-femme, d’un infirmier ou d’une infirmière, d’un assistant ou d’une assistante de service social et d’un psychologue ;

4° Ne comprendre dans leur personnel de direction et d’encadrement ainsi que dans leur personnel technique aucune personne ayant été condamnée pour des faits contraires à l’honneur, à la probité et aux bonnes moeurs ou pour une infraction prévue au titre II du livre II de la présente partie et au chapitre IV du titre III du livre IV de la partie V du présent code ;

5° Satisfaire aux conditions techniques d’installation et de fonctionnement fixées par arrêté du ministre chargé de la santé.
