Article R2312-23 of the French Labour Code

The social and economic committee is informed and consulted after the company has been notified of the direct award, by a public entity, of subsidies, loans or repayable advances, the amount of which exceeds a threshold set by order of the ministers responsible for labour, the economy, the budget and local authorities. This provision applies under the same conditions to grants, loans and repayable advances awarded under Community programmes or funds.

Information and consultation relate to the nature of the aid, its purpose, its amount and the conditions for payment and use set, where applicable, by the awarding public entity.

These provisions do not apply to the funding mentioned in the first paragraph which is awarded by public authorities to public establishments attached to them, or to subsidies for public service charges awarded by a public authority.

Article R2312-23

Le comité social et économique est informé et consulté après notification à l’entreprise de l’attribution directe, par une personne publique, de subventions, prêts ou avances remboursables dont le montant excède un seuil fixé par arrêté pris par les ministres chargés du travail, de l’économie, du budget et des collectivités territoriales. Cette disposition s’applique dans les mêmes conditions aux subventions, prêts et avances remboursables attribués dans le cadre de programmes ou fonds communautaires.

L’information et la consultation portent sur la nature de l’aide, son objet, son montant et les conditions de versement et d’emploi fixées, le cas échéant, par la personne publique attributrice.

Ces dispositions ne sont applicables ni aux financements mentionnés au premier alinéa qui sont attribués par les collectivités publiques aux établissements publics qui leur sont rattachés, ni aux subventions pour charges de service public attribuées par une collectivité publique.
