Article R2312-41 of the French Labour Code

The Social and Economic Committee is represented on:

1° the boards of directors of social security organisations and mutual societies established within the company, as well as on the supervisory committees of these institutions;

2° the boards of directors of housing and allotment garden activities.

This representation is ensured by two delegates appointed by the Committee, preferably chosen from among the participants of these institutions.

The delegates attend the meetings of these boards and committees. One of them attends the meetings of the bureau.

The social and economic committee is consulted prior to any decision relating either to the modification of the institution’s articles of association, or to the creation of new activities, or to the transformation or abolition of existing activities.

The delegates shall inform the Committee of all decisions taken by the Councils or Bureaux and of the general operation of the institution.

Le comité social et économique est représenté auprès :

1° Des conseils d’administration des organismes de sécurité sociale, des mutuelles établies dans l’entreprise ainsi qu’auprès des commissions de contrôle de ces institutions ;

2° Des conseils d’administration des activités de logements et de jardins familiaux.

Cette représentation est assurée par deux délégués désignés par le comité, choisis de préférence parmi les participants de ces institutions.

Les délégués assistent aux réunions de ces conseils et commissions. L’un d’eux assiste aux réunions du bureau.

Le comité social et économique est consulté préalablement à toute délibération relative, soit à la modification des statuts de l’institution, soit à la création d’activités nouvelles, soit à la transformation ou à la suppression d’activités existantes.

Les délégués informent le comité de toutes décisions prises par les conseils ou bureaux ainsi que de la marche générale de l’institution.
