Article R2312-42 of the French Labour Code

For social security bodies established in the company, housing and allotment garden activities, when decisions are subject to control or approval by the administration, the opinion of the Social and Economic Committee is appended to them.

In the cases set out in article R. 2312-41, the committee may oppose their implementation, unless an appeal is lodged with the minister responsible for labour.

In the case of company mutuals, when decisions are submitted to the administration for approval, the opinion of the committee is appended. In addition, the social and economic committee may make its opinion known to the general meeting on the operation of the institution.

Article R2312-42

Pour les organismes de sécurité sociale établis dans l’entreprise, les activités de logements et de jardins familiaux, lorsque des décisions sont soumises au contrôle ou à l’approbation de l’administration, l’avis du comité social et économique y est annexé.

Dans les cas énoncés à l’article R. 2312-41, le comité peut s’opposer à leur exécution, sauf recours auprès du ministre chargé du travail.

Dans les mutuelles d’entreprise, lorsque des décisions sont soumises à l’approbation de l’administration, l’avis du comité y est annexé. En outre, le comité social et économique peut faire connaître son avis à l’assemblée générale sur le fonctionnement de l’institution.
