Article R2312-60 of the French Labour Code

In undertakings or bodies in which the responsibilities of the social and economic committee are devolved to staff representation bodies provided for by provisions other than those of the present code, these are substituted for the social and economic committee for the application of the provisions of:

1° Articles L. 6322-6 and R. 6322-3 to R. 6322-11, relating to individual training leave;

2° Article L. 6331-12, relating to the participation of employers with ten or more employees in the development of continuing vocational training;

3° Articles R. 6322-66 to R. 6322-78, relating to teaching and research leave and training leave for employees aged twenty-five and under;

4° Articles D. 6321-1 and D. 6321-3, relating to the conduct of training courses.

Dans les entreprises ou organismes dans lesquels les attributions du comité social et économique sont dévolues à des instances de représentation du personnel prévues par d’autres dispositions que celles du présent code, celles-ci sont substituées au comité social et économique pour l’application des dispositions :


1° Des articles L. 6322-6 et R. 6322-3 à R. 6322-11, relatives au congé individuel de formation ;


2° De l’article L. 6331-12, relatives à la participation des employeurs de dix salariés et plus au développement de la formation professionnelle continue ;


3° Des articles R. 6322-66 à R. 6322-78, relatives au congé d’enseignement et de recherche ainsi qu’au congé de formation pour les salariés âgés de vingt-cinq ans et moins ;


4° Des articles D. 6321-1 et D. 6321-3, relatives au déroulement des actions de formation.
