Article R2312-61 of the French Labour Code

In undertakings with fifty or more employees which are not required to have a social and economic committee or a body of the type mentioned in article R. 2312-60, a special committee is set up and consulted under the conditions provided for in article L. 6331-12.

The special commission comprises as many members as there are trade union organisations that have legally constituted or are entitled to constitute a trade union section in the company.

Each of these organisations appoints one member chosen from among the employees of this company. This member fulfils the conditions required for eligibility as a member of a social and economic committee.

Dans les entreprises de cinquante salariés et plus qui ne sont pas tenues d’avoir un comité social et économique ou un organisme de la nature de ceux mentionnés à l’article R. 2312-60, il est créé une commission spéciale consultée dans les conditions prévues à l’article L. 6331-12.


La commission spéciale comprend autant de membres qu’il y a d’organisations syndicales qui ont constitué légalement ou qui ont droit de constituer une section syndicale dans l’entreprise.


Chacune de ces organisations désigne un membre choisi parmi les salariés de cette entreprise. Ce membre remplit les conditions requises pour l’éligibilité en qualité de membre d’un comité social et économique.
