Article R2314-1 of the French Labour Code

In the absence of stipulations in the agreement provided for in the third paragraph of article L. 2314-1, the number of members of the staff delegation of the social and economic committee provided for in article L. 2314-1 is defined in the table below.

In the absence of stipulations in the agreement provided for in article L. 2314-7, the monthly time required for the performance of their duties by the representatives mentioned in 1° of article L. 2315-7 is set within the limits of a duration defined in the table below. This number of hours may be increased in the event of exceptional circumstances.

Where the members of the social and economic committee are also local representatives, the time required to carry out their duties as defined by the agreement provided for in article L. 2313-7 may remain unchanged from the time available to them under the agreement provided for in article L. 2314-7 or, failing this, the table below.

The number of employees is assessed within the framework of the company or within the framework of each separate establishment.

Article R2314-1

A défaut de stipulations dans l’accord prévu au troisième alinéa de l’article L. 2314-1, le nombre de membres de la délégation du personnel du comité social et économique prévu à l’article L. 2314-1 est défini dans le tableau ci-après.

A défaut de stipulations dans l’accord prévu à l’article L. 2314-7, le temps mensuel nécessaire à l’exercice de leurs fonctions par les représentants mentionnés au 1° de l’article L. 2315-7 est fixé dans les limites d’une durée définie dans le tableau ci-après. Ce nombre d’heures peut être augmenté en cas de circonstances exceptionnelles.

Lorsque les membres du comité social et économique sont également représentants de proximité, le temps nécessaire à l’exercice de leurs fonctions défini par l’accord prévu à l’article L. 2313-7 peut rester inchangé par rapport au temps dont ils disposent en vertu de l’accord prévu à l’article L. 2314-7 ou, à défaut du tableau ci-dessous.

Les effectifs s’apprécient dans le cadre de l’entreprise ou dans le cadre de chaque établissement distinct.
