Article R2315-43 of the French Labour Code

The invitation by the statutory auditor to convene a meeting of the social and economic committee in the cases provided for in the second paragraph of article L. 2315-74 is sent to the employer by any means capable of giving a definite date to the receipt of this invitation, within eight days of receipt of the reply from the committee secretary or the establishment of the absence of a reply within the period provided for in article R. 2315-42. This invitation shall be accompanied by the auditor’s special report. The auditor shall send a copy of these documents without delay to the members of the social and economic committee and to the president of the court.

The employer shall convene a meeting of the social and economic committee within fifteen days of receiving the auditor’s invitation to discuss the matters raised. The statutory auditor is convened to this meeting under the same conditions as the members of the committee.

An extract of the minutes of the meeting is sent to the President of the Court and to the auditor, by any means capable of giving a date certain of its receipt, within eight days of the Committee meeting.

L’invitation par le commissaire aux comptes à réunir le comité social et économique dans les cas prévus au deuxième alinéa de l’article L. 2315-74 est adressée à l’employeur par tout moyen propre à donner date certaine à la réception de cette invitation, dans les huit jours qui suivent la réception de la réponse du secrétaire du comité ou la constatation de l’absence de réponse dans le délai prévu à l’article R. 2315-42. Cette invitation est accompagnée du rapport spécial du commissaire aux comptes. Le commissaire aux comptes adresse sans délai une copie de ces documents aux membres du comité social et économique et au président du tribunal.

L’employeur réunit le comité social et économique dans les quinze jours qui suivent la réception de l’invitation du commissaire aux comptes en vue de le faire délibérer sur les faits relevés. Le commissaire aux comptes est convoqué à cette réunion dans les mêmes conditions que les membres du comité.

Un extrait du procès-verbal de la réunion est adressé au président du tribunal et au commissaire aux comptes, par tout moyen propre à donner date certaine à sa réception, dans les huit jours qui suivent la réunion du comité.
