The person concerned and his counsel, where applicable, the person(s) with parental authority or the legal representative, as well as the representative of the Agency’s College, the World Anti-Doping Agency, the International Federation and, where applicable, the foreign national organisation, the sports federation and the professional league concerned, may submit written or oral observations to the Sanction Commission. Where such observations are made in writing, they must be received at the agency’s head office at least six days before the hearing.
This time limit is reduced to three days if the person is domiciled outside mainland France.
Written observations duly received by the Committee are forwarded to the parties without delay.
The person concerned and his or her counsel, where applicable, the person(s) exercising parental authority or the legal representative and the representative of the college may ask to be heard persons of their choice, whose names they shall provide at least six days before the hearing. The chairman of the panel may refuse, in a reasoned decision, manifestly unreasonable requests to be heard.
This time limit is reduced to three days if the person concerned is domiciled outside mainland France.
The panel may also hold any hearings and consultations it deems useful. If it is decided to hold such a hearing, the Chairman of the panel shall inform the person concerned and, where applicable, his representatives, as well as the representative of the College, prior to the meeting. If this information proves impossible before the meeting initially scheduled, the examination of the interested party’s file is postponed to a later meeting. If it is decided to hold a consultation, the results will be forwarded to the same persons.
The travel expenses of the persons whose hearing is decided under the conditions provided for in the previous paragraph shall be paid by the Agency.
