Article R232-95 of the French Sports Code

The rapporteur presents his report orally at the hearing.

The member of the Board or the agent of the Agency appointed pursuant to the last paragraph of Article R. 232-11 may attend the hearing and present observations. Where appropriate, the member of the Board may be assisted by an agent of the Agency.

The person concerned, his counsel and, where applicable, the person(s) exercising parental authority or the legal representative shall be invited to speak last.

Discussions shall not be public unless a request to the contrary is made by the person concerned, his or her counsel or, where applicable, the person(s) exercising parental authority or the legal representative, before the meeting opens.

The member of the Board or the agent of the Agency appointed pursuant to the last paragraph of Article R. 232-11 to represent the Board may also request that the proceedings be made public, provided that the person concerned has given his consent in writing.

The Chairman may reject the request for the proceedings to be made public on grounds of public order or confidentiality protected by law.

Le rapporteur présente oralement son rapport lors de l’audience.

Le membre du collège ou l’agent de l’agence désigné en application du dernier alinéa de l’article R. 232-11 peut assister à l’audience et présenter des observations. Le cas échéant, le membre du collège peut être assisté par un agent de l’agence.

L’intéressé, son conseil, et le cas échéant, la ou les personnes investies de l’autorité parentale ou le représentant légal sont invités à prendre la parole en dernier.

Les débats ne sont pas publics sauf demande contraire formulée, avant l’ouverture de la séance, par l’intéressé, ou son conseil, ou le cas échéant, la ou les personnes investies de l’autorité parentale ou le représentant légal.

Le membre du collège ou l’agent de l’agence désigné en application du dernier alinéa de l’article R. 232-11 pour représenter le collège peut également demander la publicité des débats, à condition que l’intéressé ait donné son consentement par écrit.

Le président peut rejeter la demande de publicité des débats pour des motifs tenant à l’ordre public ou à un secret protégé par la loi.
