Article R2321-10 of the French Public Health Code

Where it appears that a director no longer fulfils the conditions for which he or she was approved, approval will be withdrawn by the Director General of the Regional Health Agency. Withdrawal of approval is notified by registered letter to the person concerned and to the operator of the children’s home. The letter sent to the person concerned will state the reasons for the decision.

At the same time, the operator is informed that, failing which the authorisation will be withdrawn, it must send the Director General of the Regional Health Agency the application for authorisation of a new director within a specified period.

Lorsqu’il apparaît qu’un directeur ne remplit plus les conditions à raison desquelles il avait été agréé, l’agrément lui est retiré par le directeur général de l’agence régionale de santé. Le retrait d’agrément est notifié par lettre recommandée à l’intéressé, d’une part, et à l’exploitant de la maison d’enfants, d’autre part. La lettre adressée à l’intéressé indique les motifs de la décision.

L’exploitant est en même temps informé que, sous peine du retrait d’autorisation, il doit, dans un délai qui lui est imparti, faire parvenir au directeur général de l’agence régionale de santé le dossier de demande d’agrément d’un nouveau directeur.
