Article R2322-12 of the French Public procurement code

The purchaser may award, without prior advertising or competitive tendering, contracts for the performance of services similar to those awarded to the holder of a previous contract awarded after competitive tendering. The first contract must have indicated the possibility of using this procedure for similar services. The call for competition must also have taken into account the total amount envisaged, including that of the new works or services.
The period during which contracts for similar services or works may be concluded may not exceed five years from the notification of the initial contract, except in exceptional circumstances determined by taking into account the expected lifetime of the objects, installations or systems supplied, as well as the technical difficulties which a change of contractor may cause.

L’acheteur peut passer sans publicité ni mise en concurrence préalables des marchés ayant pour objet la réalisation de prestations similaires à celles qui ont été confiées au titulaire d’un marché précédent passé après mise en concurrence. Le premier marché doit avoir indiqué la possibilité de recourir à cette procédure pour la réalisation de prestations similaires. Sa mise en concurrence doit également avoir pris en compte le montant total envisagé, y compris celui des nouveaux travaux ou services.
La durée pendant laquelle les marchés de services ou de travaux similaires peuvent être conclus ne peut dépasser cinq ans à compter de la notification du marché initial, sauf dans des circonstances exceptionnelles déterminées en tenant compte de la durée de vie prévue des objets, installations ou systèmes livrés, ainsi que des difficultés techniques que peut occasionner un changement de titulaire.
