Article R2322-14 of the French Public procurement code

The purchaser may award a contract without prior advertising or competitive tendering to meet a need with an estimated value of less than €100,000 excluding tax or for lots with an estimated value of less than €80,000 excluding tax that meet the conditions set out in b of 2° of article R. 2323-1.

The purchaser shall ensure that it selects a relevant tender, makes good use of public funds and does not systematically contract with the same economic operator when there is more than one tender likely to meet the requirement.

Article R2322-14

L’acheteur peut passer un marché sans publicité ni mise en concurrence préalables pour répondre à un besoin dont la valeur estimée est inférieure à 100 000 euros hors taxes ou pour les lots dont le montant est inférieur à 80 000 euros hors taxes et qui remplissent les conditions prévues au b du 2° de l’article R. 2323-1.

L’acheteur veille à choisir une offre pertinente, à faire une bonne utilisation des deniers publics et à ne pas contracter systématiquement avec un même opérateur économique lorsqu’il existe une pluralité d’offres susceptibles de répondre au besoin.
