Article R2322-8 of the French Public procurement code

The purchaser may award, without prior advertising or competitive tendering, a contract for the additional purchase of supplies performed by the contract holder and intended either as a partial replacement of commonly used supplies or installations, or as the extension of existing supplies or installations, where a change of contract holder would require the acquisition of equipment using a different technique that would result in incompatibility with the equipment already acquired or disproportionate technical difficulties in use and maintenance.
The duration of these additional supply contracts, including renewal periods, may not exceed five years, except in exceptional circumstances determined by taking into account the expected service life of the objects, installations or systems supplied, as well as the technical difficulties that a change of contractor may cause.

L’acheteur peut passer sans publicité ni mise en concurrence préalables un marché pour les achats complémentaires de fournitures qui sont exécutés par le titulaire du marché et qui sont destinés soit au renouvellement partiel de fournitures ou d’installations d’usage courant, soit à l’extension de fournitures ou d’installations existantes, lorsque le changement de titulaire obligerait à acquérir un matériel de technique différente entraînant une incompatibilité avec le matériel déjà acquis ou des difficultés techniques d’utilisation et d’entretien disproportionnées.
La durée de ces marchés complémentaires de fournitures, périodes de reconduction comprises, ne peut dépasser cinq ans sauf dans des circonstances exceptionnelles déterminées en tenant compte de la durée de vie prévue des objets, installations ou systèmes livrés, ainsi que des difficultés techniques que peut occasionner un changement de titulaire.
