Article R2323-1 of the French Public procurement code

Without prejudice to the provisions of Article R. 2322-14, the purchaser may use an adapted procedure to award:

1° A defence or security contract for which the estimated value of the requirement, excluding taxes, is less than the European thresholds mentioned in a notice annexed to this Code;

2° A batch of an allotted defence or security contract for which the total amount is equal to or greater than the formalised procedure thresholds and which meets both of the following conditions:

a) The estimated value of each lot concerned is less than €80,000 excluding tax for supplies or services or €1 million excluding tax for works;

b) The aggregate value of these lots does not exceed 20% of the total estimated value of all the lots.

Sans préjudice des dispositions de l’article R. 2322-14, l’acheteur peut recourir à une procédure adaptée pour passer :


1° Un marché de défense ou de sécurité dont la valeur estimée hors taxes du besoin est inférieure aux seuils européens mentionnés dans un avis qui figure en annexe du présent code ;


2° Un lot d’un marché de défense ou de sécurité alloti dont le montant total est égal ou supérieur aux seuils de procédure formalisée et qui remplit les deux conditions suivantes :


a) La valeur estimée de chaque lot concerné est inférieure à 80 000 euros hors taxes pour des fournitures ou des services ou à 1 million d’euros hors taxes pour des travaux ;


b) Le montant cumulé de ces lots n’excède pas 20 % de la valeur totale estimée de tous les lots.
