Article R233-7 of the French Code of civil enforcement procedures

A copy of the specifications is sent to the company, which informs the shareholders.

On the same day, any other opposing creditors are summoned to inspect the specifications at the premises of the person responsible for the sale.

Any interested party may submit observations on the content of the specifications to the person in charge of the sale. Such observations shall no longer be admissible on expiry of a period of two months from the notification provided for in the first paragraph.

Members who wish to avail themselves of the provisions of the second paragraph of Article 1868 of the Civil Code must inform the person responsible for the sale.

Une copie du cahier des charges est notifiée à la société qui en informe les associés.


Le même jour, une sommation est notifiée, s’il y a lieu, aux autres créanciers opposants d’avoir à prendre connaissance du cahier des charges chez la personne chargée de la vente.


Tout intéressé peut formuler auprès de cette dernière des observations sur le contenu du cahier des charges. Ces observations ne sont plus recevables à l’expiration d’un délai de deux mois à compter de la notification prévue au premier alinéa.


Les associés qui entendent se prévaloir des dispositions du deuxième alinéa de l’article 1868 du code civil en informent la personne chargée de la vente.
