Article R233-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

European Union citizens mentioned in 4° or 5° of article L. 233-1 admitted to residence in their capacity as a family member, retain their right to residence in the following situations:
1° In the event of the death of the accompanied or joined national or if the latter leaves France;
2° In the event of divorce or annulment of the marriage with the accompanied or joined national.
Prior to acquiring the right of permanent residence provided for in the first paragraph of Article L. 234-1, they must meet, on an individual basis, the conditions of Article L. 233-1.

Les citoyens de l’Union européenne mentionnés aux 4° ou 5° de l’article L. 233-1 admis au séjour en leur qualité de membre de famille, conservent leur droit au séjour dans les situations suivantes :
1° En cas de décès du ressortissant accompagné ou rejoint ou si celui-ci quitte la France ;
2° En cas de divorce ou d’annulation du mariage avec le ressortissant accompagné ou rejoint.
Avant l’acquisition du droit de séjour permanent prévu au premier alinéa de l’article L. 234-1, ils doivent remplir, à titre individuel, les conditions de l’article L. 233-1.
