Article R2334-29 of the French General Code of Local Authorities

When the beneficiary of the subsidy has not declared completion of the operation within four years of the date on which the start of execution was declared, the operation is deemed to have been completed. The Prefect will liquidate the operation under the conditions set out in I of article R. 2334-30 and in the last paragraph of article R. 2334-31. No request for payment from the beneficiary may be made after this period has expired.

However, the Prefect may exceptionally, by reasoned decision, extend the implementation period for a period that may not exceed two years. Before doing so, the Prefect will check that the initial project has not been altered and that the beneficiary is not responsible for the incompletion of the operation.

Lorsque le bénéficiaire de la subvention n’a pas déclaré l’achèvement de l’opération dans un délai de quatre ans à compter de la date de déclaration du début d’exécution, celle-ci est considérée comme terminée. Le préfet liquide l’opération dans les conditions fixées au I de l’article R. 2334-30 et au dernier alinéa de l’article R. 2334-31. Aucune demande de paiement de la part du bénéficiaire ne peut intervenir après expiration de ce délai.

Toutefois, le préfet peut exceptionnellement, par décision motivée, prolonger le délai d’exécution pour une durée qui ne peut excéder deux ans. Au préalable, il vérifie que le projet initial n’est pas dénaturé et que l’inachèvement de l’opération n’est pas imputable au bénéficiaire.
