I. – An indicator of the resources of the communes of New Caledonia is created, which corresponds to the sum of:
a) The flat-rate allocation of the global operating allocation defined in Article L. 2334-7 collected the previous year;
b) The product of additional centimes collected the penultimate year by the communes under Article 52 of the Organic Law of 19 March 1999 relating to New Caledonia;
c) The product of own taxation collected the penultimate year by the communes under 1° of Article 22 of the Organic Law of 19 March 1999 relating to New Caledonia.
II. – Communes whose per capita resource indicator is lower than the average per capita resource indicator for New Caledonia are entitled to an allocation from the fund.
Allocations for each of the communes eligible under the fund are calculated, in proportion to the relative difference between the average per capita resource indicator for New Caledonia and the commune’s per capita resource indicator, multiplied by the commune’s population.
The population to be taken into account for the application of this article is that defined in Article L. 2334-2.
III. – The High Commissioner of the Republic notifies the allocations due to the communes.
IV. – The individual repayments determined for each commune are made monthly once the distribution of allocations has been notified.
