Article R234-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Whatever their nationality, family members residing with the European Union citizen referred to in 1° of article L. 233-1 acquire a right to permanent residence on French territory before the end of the uninterrupted five-year period of legal residence provided for in article L. 234-1 in the following cases:
1° The worker himself benefits from the right to permanent residence pursuant to articles R. 234-4 and R. 234-5;
2° The worker dies while still carrying out a professional activity in France and has resided there regularly and continuously for more than two years;
3° The worker dies while still carrying out a professional activity in France following an accident at work or an occupational disease;
4° The spouse of the deceased worker has lost French nationality following their marriage to this worker.

Article R234-6

Quelle que soit leur nationalité, les membres de famille qui résident avec le citoyen de l’Union européenne mentionné au 1° de l’article L. 233-1 acquièrent un droit au séjour permanent sur le territoire français avant l’écoulement de la période ininterrompue de cinq ans de séjour régulier prévue à l’article L. 234-1 dans les cas suivants :
1° Le travailleur bénéficie lui-même du droit au séjour permanent en application des articles R. 234-4 et R. 234-5 ;
2° Le travailleur décède alors qu’il exerçait encore une activité professionnelle en France et qu’il y a séjourné de façon régulière et continue depuis plus de deux ans ;
3° Le travailleur décède alors qu’il exerçait encore une activité professionnelle en France à la suite d’un accident du travail ou d’une maladie professionnelle ;
4° Le conjoint du travailleur décédé a perdu la nationalité française à la suite de son mariage avec ce travailleur.
