Article R2351-16 of the French Public procurement code

A tenderer may not be asked to obtain a commitment from a Member State of the European Union which would prejudice the freedom of that Member State to apply, in accordance with relevant international or European Union law, its national criteria for authorising exports, transfers or transits, in the circumstances prevailing at the time of the authorisation decision.

Il ne peut être demandé à un soumissionnaire d’obtenir d’un Etat membre de l’Union européenne un engagement qui porterait atteinte à la liberté dudit Etat membre d’appliquer, conformément au droit international ou de l’Union européenne pertinent, ses critères nationaux en matière d’autorisation des exportations, transferts ou transits, dans les circonstances prévalant au moment de la décision d’autorisation.
