Article R2363-3 of the French Labour Code

Disputes relating to the appointment of the employees’ representatives and the election of the members of the committee of the European Cooperative Society having its registered office in France, as well as to the appointment of the employees’ representatives of the participating persons, establishments or subsidiaries located in France, are within the jurisdiction of the judicial court either of the registered office, as the case may be, of the European Cooperative Society, of the legal person, of the subsidiary or of the establishment concerned, or of the domicile of the natural person participating in the constitution of the European Cooperative Society.

These disputes are lodged, investigated and judged in accordance with the procedures laid down in articles R. 2324-24 and R. 2324-25.

The appeal must be lodged within fifteen days of notification of the appointment to the employer.

Les contestations relatives à la désignation des représentants des salariés et à l’élection des membres du comité de la société coopérative européenne dont le siège se situe en France, ainsi qu’à la désignation des représentants des salariés des personnes participantes, des établissements ou filiales implantés en France, sont de la compétence du tribunal judiciaire soit du siège, selon le cas, de la société coopérative européenne, de la personne morale, de la filiale ou de l’établissement concerné, soit du domicile de la personne physique participant à la constitution de la société coopérative européenne.

Ces contestations sont formées, instruites et jugées selon les modalités prévues aux articles R. 2324-24 et R. 2324-25.

Le recours est formé dans un délai de quinze jours à compter de la notification de la désignation à l’employeur.
