Article R2373-1 of the French Public procurement code

Defence or security partnership contracts are subject to the provisions of this Book, with the exception of:
1° The provisions of Sections 2 and 3 of Chapter II of Title I;
2° The provisions of Chapter I of Title IX;
3° The provisions of Section 2 of Chapter III of Title IX.
They are also subject to the provisions of Book II, with the exception of Article R. 2200-1, subject to the following provisions:
1° The threshold provided for in Article L. 2211-5, above which purchasers may use partnership contracts, is set at 20 million euros excluding taxes;
2° The minimum proportion that the contractor undertakes to entrust, directly or indirectly, to small and medium-sized enterprises or to craftsmen pursuant to Article R. 2213-5, is set at 10% of the estimated contract value excluding financing costs, except where the economic structure of the sector concerned, security of supply or security of information do not allow this.

Article R2373-1

Les marchés de partenariat de défense ou de sécurité sont soumis aux dispositions du présent livre, à l’exception :
1° Des dispositions des sections 2 et 3 du chapitre II du titre Ier ;
2° Des dispositions du chapitre Ier du titre IX ;
3° Des dispositions de la section 2 du chapitre III du titre IX.
Ils sont également soumis aux dispositions du livre II, à l’exception de son article R. 2200-1, sous réserve des dispositions suivantes :
1° Le seuil prévu à l’article L. 2211-5, au-delà duquel les acheteurs peuvent recourir au marché de partenariat, est fixé à 20 millions d’euros hors taxes ;
2° La part minimale que le titulaire s’engage à confier, directement ou indirectement, à des petites et moyennes entreprises ou à des artisans en application de l’article R. 2213-5, est fixée à 10 % du montant prévisionnel du contrat hors coût de financement, sauf lorsque la structure économique du secteur concerné, la sécurité des approvisionnements ou celle des informations ne le permettent pas.
