Article R2393-3 of the French Public procurement code

The provisions of sub-section 1 specify the procedures by which the purchaser may require the holder of a defence or security contract to use a competitive tendering procedure to select its sub-contractor or sub-contractors.

The provisions of sub-section 2 specify the obligations of the holder when the purchaser requires it to sub-contract part of its contract.

The provisions of sub-section 3 specify the rules for the competitive tendering of sub-contractors applicable to the holder of the contract.

The provisions of sub-sections 4 and 5 apply to all cases where the contractor uses sub-contractors.

Les dispositions de la sous-section 1 précisent les modalités par lesquelles l’acheteur peut imposer au titulaire d’un marché de défense ou de sécurité de recourir à une mise en concurrence pour choisir son ou ses sous-contractants.


Les dispositions de la sous-section 2 précisent les obligations du titulaire lorsque l’acheteur lui impose de sous-contracter une partie de son marché.


Les dispositions de la sous-section 3 précisent les règles de mise en concurrence des sous-contractants applicables au titulaire du marché.


Les dispositions des sous-sections 4 et 5 s’appliquent à l’ensemble des cas où le titulaire recourt à des sous-contractants.
