Article R2393-8 of the French Public procurement code

The purchaser shall indicate in the contract notice the minimum proportion of the contract value that the contractor will be required to subcontract in the form of a range comprising a minimum percentage and a maximum percentage which may not exceed 30% of the contract value.

The percentages must be proportionate to the subject and value of the contract and to the nature of the industrial sector concerned, in particular the level of competition prevailing in that sector and the relevant technical capabilities of the industrial base.

L’acheteur indique dans l’avis de marché la part minimale du montant du marché que le titulaire sera tenu de sous-contracter sous la forme d’une fourchette comportant un pourcentage minimum et un pourcentage maximum lequel ne peut pas dépasser 30 % du montant du marché.

Les pourcentages doivent être proportionnés à l’objet et à la valeur du marché ainsi qu’à la nature du secteur industriel concerné, notamment le niveau de concurrence prévalant dans ce secteur et les capacités techniques concernées de la base industrielle.
