Article R2396-5 of the French Public procurement code

Undertakings linked to the contractor and subcontractors involved in the performance of the contract are subject to the obligations set out in this section if, unless otherwise stipulated in the contract, they individually account for more than 10% of the value of the contract and more than 10 million euros excluding tax.

Sont soumis aux obligations prévues par la présente section les entreprises liées au titulaire ainsi que les sous-contractants intervenant dans l’exécution du marché, lorsque ces derniers réalisent individuellement, sauf stipulation contraire du marché, une part supérieure à 10 % du montant du marché et d’un montant supérieur à 10 millions d’euros hors taxes.
