Article R2396-6 of the French Public procurement code

During the performance of the contract, the purchaser may ask the competent administrative authority or, in the case of a contractor established abroad, refer the matter to the national security authority or the delegated security authority for the purpose of requesting the national security authority of the contractor’s State or the designated security authority of that State, subject to the existence of security agreements and within a time limit it shall set, to:

1° Provide proof of the security clearances it has issued;

2° Verify the conformity of the premises and installations likely to be used, the industrial and administrative procedures that will be followed, the information management arrangements or the situation of the personnel likely to be employed for the performance of the contract, without prejudice to the possibility of carrying out other investigations and taking them into account.

Article R2396-6

Pendant l’exécution du marché, l’acheteur peut demander à l’autorité administrative compétente ou, dans le cas d’un titulaire établi à l’étranger, saisir l’autorité nationale de sécurité ou l’autorité de sécurité déléguée aux fins de solliciter l’autorité nationale de sécurité de l’Etat du titulaire ou à l’autorité de sécurité désignée de cet Etat, sous réserve de l’existence d’accords de sécurité et dans un délai qu’il fixe, de :

1° Justifier des habilitations de sécurité qu’elle a délivrées ;

2° Vérifier la conformité des locaux et installations susceptibles d’être utilisés, les procédures industrielles et administratives qui seront suivies, les modalités de gestion de l’information ou la situation du personnel susceptible d’être employé pour l’exécution du marché, sans préjudice de la possibilité de procéder à d’autres enquêtes et d’en tenir compte.
