Article R24-15 of the French Code of Criminal Procedure

The judge may only apply the provisions of article 138-3 only if it appears that the prohibitions set out in 3° and 9° of Article 138 are, on their own, insufficient to prevent a repetition of the offence.

In this case, the prohibition on approaching the victim and the obligation to wear an anti-seizure bracelet may only be ordered if, pursuant to article 138(3) and (9), there is also a prohibition on going to certain specified places where the victim usually lives, works or is, and a prohibition on receiving or meeting the victim or having any contact with him or her in any way whatsoever.

Le juge ne peut faire application des dispositions de l’article 138-3 que s’il lui apparaît que les interdictions prévues par les 3° et 9° de l’article 138 sont, à elles seules, insuffisantes pour prévenir le renouvellement de l’infraction.

Dans ce cas, l’interdiction de se rapprocher de la victime et l’obligation de porter un bracelet anti-rapprochement ne peuvent être ordonnées que si sont également prononcées, en application des 3° et 9° de l’article 138, l’interdiction de se rendre dans certains lieux déterminés, dans lesquels réside, travaille, ou se trouve habituellement la victime, et l’interdiction de recevoir ou de rencontrer la victime ainsi que d’entrer en relation avec elle, de quelque façon que ce soit.
