If the prohibition on contact imposed on the accused person leads, in particular as a result of contact attributable both to his movements and to those of the victim, to a large number of alerts that excessively infringe his right to respect for his private and family life, he and the victim may, at any time during the measure, request that the alert and pre-alert distances be revised, or that the obligation to wear the bracelet be terminated. The investigating judge shall then rule in accordance with the terms of article 140. This decision may also be taken ex officio by the examining magistrate.
When the person has been referred to the trial court, or placement under judicial supervision has been ordered pursuant to articles 394,396,397-1-1 or 397-3, the decision is taken by the juge des libertés et de la détention, who rules in the same way.
