Article R24-2 of the French Code of Criminal Procedure

Where the securities guarantee, in part or in full, the rights of one or more victims who have not yet been identified or who have not yet brought a civil action, they shall be established in the name of a provisional beneficiary acting on behalf of these victims and, where applicable, the Public Treasury.

The provisional beneficiary shall be chosen from among persons exercising an activity regulated by the public authority and subject to a professional insurance obligation. It is proposed by the person under investigation and accepted by the investigating judge.

The provisional beneficiary undertakes to transfer the security or securities to the victims and, where applicable, to the Treasury, in the event of the person under investigation being convicted for their benefit.

Article R24-2

Lorsque les sûretés garantissent, en partie ou en totalité, les droits d’une ou plusieurs victimes qui ne sont pas encore identifiées ou qui ne se sont pas encore constituées partie civile, elles sont établies au nom d’un bénéficiaire provisoire agissant pour le compte de ces victimes et, le cas échéant, du Trésor public.

Le bénéficiaire provisoire est choisi parmi les personnes exerçant une activité réglementée par l’autorité publique et soumise à une obligation d’assurance professionnelle. Il est proposé par la personne mise en examen et accepté par le juge d’instruction.

Le bénéficiaire provisoire s’engage à transférer la ou les sûretés aux victimes et, le cas échéant, au Trésor public, en cas de condamnation à leur profit de la personne mise en examen.
