Article R241-16-3 of the French Sports Code

When the administrative composition procedure is terminated in accordance with Article R. 232-89-1, the statement of objections is forwarded to the chairman of the Enforcement Committee. Articles R. 232-90-1 and R. 241-17 to R. 241-24 are then applied.

The Agency informs the interested party that he is invited to present his written observations on the complaints notified to the Sanction Commission, within the time limit mentioned in the first paragraph of article R. 232-93, and that he may consult the documents in the file at the Sanction Commission, have a copy delivered or sent to him, and be represented or assisted under the conditions set out in article R. 241-17.

The sports federation concerned is notified of the statement of objections sent to the chairman of the Sanctions Committee and informed of the opportunity to submit written observations to the Committee.

The International Federation concerned shall be informed that the objections have been forwarded to the Chairman of the Sanction Commission and that it may submit written observations to the Sanction Commission.

If the validation of an agreement by the College takes place after the notification of the objections has been forwarded to the Chairman of the Sanctions Committee, the case is not referred to the Sanctions Committee. The second paragraph of III of Article R. 241-16-1 is then applied.

Lorsqu’il est mis fin à la procédure de composition administrative dans les conditions prévues à l’article R. 232-89-1, la notification des griefs est transmise au président de la commission des sanctions. Il est alors fait application des articles R. 232-90-1 et R. 241-17 à R. 241-24.

L’agence informe l’intéressé qu’il est invité à présenter à la commission des sanctions, dans le respect du délai mentionné au premier alinéa de l’article R. 232-93, ses observations écrites sur les griefs qui lui ont été notifiés et qu’il peut prendre connaissance des pièces du dossier auprès de la commission des sanctions, ainsi que s’en faire délivrer ou adresser une copie, et se faire représenter ou assister dans les conditions prévues à l’article R. 241-17.

La fédération sportive concernée est rendue destinataire de la notification des griefs transmise au président de la commission des sanctions et informée de la possibilité de présenter des observations écrites devant cette commission.

La fédération internationale concernée est informée de la transmission des griefs au président de la commission des sanctions et de la possibilité de présenter des observations écrites devant cette commission.

Lorsque la validation d’un accord par le collège intervient après la transmission de la notification des griefs au président de la commission des sanctions, cette dernière est dessaisie de l’affaire. Il est alors fait application du deuxième alinéa du III de l’article R. 241-16-1.
