Article R2411-12 of the French General Code of Local Authorities

The special trade union committee authorises the chairman to bring the initial action, the appeals, and to sign any request for withdrawal or settlement intended to bring the legal action to an end.

The chairman is authorised to represent the section in the legal action concerned and, in this capacity, to take on behalf of the section and without special authorisation from the committee all other acts useful to the proceedings.

Article R2411-12

La commission syndicale spéciale autorise le président à exercer l’action initiale, les voies de recours, et à signer toute demande de désistement ou transaction destinée à mettre un terme à l’action en justice.

Le président est habilité à représenter la section dans l’action en justice concernée et, à ce titre, à prendre au nom de la section et sans autorisation spéciale de la commission tous les autres actes utiles à l’instance.
