Article R2421-19 of the French Labour Code

The Labour Inspector will give the employee the opportunity to submit written observations and, at his request, oral observations. On this occasion, the employee may, at his request, be assisted by a representative of his trade union. Without prejudice to the preceding provisions, the Labour Inspector may also carry out an adversarial investigation as defined in paragraph 1 of article R. 2421-4.

The provisions of the third paragraph of article R. 2421-4 and those of article R. 2421-5 apply.

Article R2421-19

L’inspecteur du travail met à même le salarié de lui présenter ses observations écrites, et sur sa demande, des observations orales. A cette occasion, le salarié peut, sur sa demande, se faire assister d’un représentant de son syndicat. Sans préjudice des dispositions précédentes, l’inspecteur du travail peut en outre procéder à une enquête contradictoire telle que définie à l’alinéa 1er de l’article R. 2421-4.


Les dispositions du troisième alinéa de l’article R. 2421-4 et celles de l’article R. 2421-5 s’appliquent.
