Article R2431-32 of the French Public procurement code

When the construction methods or techniques or the industrial products to be used mean that the economic operator responsible for the works or the supplier of industrial products must be involved from the time the preliminary designs are drawn up, the contracting authority may decide to consult them in advance for one or more public contracts involving special technical requirements.
This consultation takes place either at the end of the preliminary or final design studies for new building works and for building and infrastructure refurbishment projects, or at the end of the preliminary studies for new infrastructure works.
The economic operator responsible for the works or the supplier of industrial products selected after consultation draws up and submits to the project owner the graphic and written documents defining the technical solutions it proposes.

Lorsque les méthodes ou techniques de réalisation ou les produits industriels à mettre en œuvre impliquent l’intervention, dès l’établissement des avant-projets, de l’opérateur économique chargé des travaux ou du fournisseur de produits industriels, le maître d’ouvrage peut décider de les consulter de façon anticipée pour un ou plusieurs marchés publics de technicité particulière.
Cette consultation intervient soit à l’issue des études d’avant-projet sommaire ou d’avant-projet définitif pour les ouvrages neufs de bâtiment et pour les opérations de réhabilitation de bâtiment et d’infrastructure, soit à l’issue des études préliminaires pour les ouvrages neufs d’infrastructure.
L’opérateur économique chargé des travaux ou le fournisseur de produits industriels retenu après consultation établit et remet au maître d’œuvre les documents graphiques et écrits définissant les solutions techniques qu’il propose.
