The members of the Commission de protection de l’accès aux œuvres are subject to an obligation of impartiality.
On taking up their duties, the members of the Commission shall inform the Chairman of:
1° The positions they hold, and those they have held over the previous three years, in a company or corporation controlled, within the meaning of article L. 233-3 of the French Commercial Code, by a company in the film and moving image sector;
2° Corporate offices and any interests they hold, or have held over the previous three years, in a company in the same sector;
3° Consultancy and representation activities they carry out, or have carried out over the previous three years, on behalf of a company in the same sector, either directly or within a legal entity.
When a member of the Commission takes up a new position, holds a new corporate office or acquires a new interest in a company or corporation in the film and moving image sector, he/she shall inform the Chairman without delay.
The members of the Commission personally examine the operations submitted for their assessment and deliberate on them without regard to persons or factors external to these operations. They undertake to prevent or immediately put an end to any conflict of interest, within the meaning of paragraph 1 of article 2 of Law no. 2013-907 of 11 October 2013 on the transparency of public life, which may arise in the performance of their duties.
