Article R282-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of this book to Saint-Barthélemy:
1° References to the Prefect are replaced by the reference to the State representative in the collectivity;
2° Article R. 210-1 is worded as follows:

“Art. R. 210-1.-The provisions of articles R. 141-1 to R. 141-13, R. 142-26 to R. 142-32, R. 142-41, R. 142-42 and R. 142-51 to R. 142-58 are applicable to foreign nationals whose situation is governed by this book. “;

3° In article R. 233-5, the words: “the work permit provided for in article L. 5221-2 of the French Labour Code for the exercise of a salaried activity” are replaced by the words: “the work permit for the exercise of a salaried activity under the conditions provided for by the laws and regulations applicable locally”;
4° In article R. 233-6, the words: “French labour market” are replaced by the words: “Saint-Barthélemy labour market” and the words: “without a work permit being required” are deleted;
5° In article R. 237-1, the reference to article R. 431-22 is deleted;
6° In article R. 253-1, the reference to article R. 614-1 is deleted;
7° In article R. 264-1, the references to articles R. 711-3 to R. 711-5 and R. 753-3 are deleted;
8° In article R. 270-4, the reference to article R. 812-1 is deleted.

Article R282-2

Pour l’application du présent livre à Saint-Barthélemy :
1° Les références au préfet sont remplacées par la référence au représentant de l’Etat dans la collectivité ;
2° L’article R. 210-1 est ainsi rédigé :

” Art. R. 210-1.-Sont applicables aux étrangers dont la situation est régie par le présent livre les dispositions des articles R. 141-1 à R. 141-13, R. 142-26 à R. 142-32, R. 142-41, R. 142-42 et R. 142-51 à R. 142-58. ” ;

3° A l’article R. 233-5, les mots : ” l’autorisation de travail prévue à l’article L. 5221-2 du code du travail pour l’exercice d’une activité salariée ” sont remplacés par les mots : ” l’autorisation de travail pour l’exercice d’une activité salariée dans les conditions prévues par la législation et la réglementation applicables localement ” ;
4° A l’article R. 233-6, les mots : ” marché du travail français ” sont remplacés par les mots : ” marché du travail de Saint-Barthélemy ” et les mots : ” sans que l’autorisation de travail ne soit requise ” sont supprimés ;
5° A l’article R. 237-1, la référence à l’article R. 431-22 est supprimée ;
6° A l’article R. 253-1, la référence à l’article R. 614-1 est supprimée ;
7° A l’article R. 264-1, les références aux articles R. 711-3 à R. 711-5 et R. 753-3 sont supprimées ;
8° A l’article R. 270-4, la référence à l’article R. 812-1 est supprimée.
