Article R305 of the French Code of Criminal Procedure

The first paragraph of Article R. 80 reads as follows:

“Bulletin No. 2 is requested from the registry of the court of first instance or, in accordance with the second paragraph of Article R. 62, from the automated national criminal record department, by letter, telegram, fax or teletransmission, indicating the civil status of the person whose bulletin is requested, the status of the requesting authority and the reason for the request.

“If the person whose bulletin is requested is a legal entity, the request must include an indication of its name, its registration in the company identification register and its registered office. Where the legal entity is not registered, proof of its identity must be attached in support of the request. “

Le premier alinéa de l’article R. 80 est rédigé comme suit :

” Le bulletin n° 2 est réclamé au greffe du tribunal de première instance ou, conformément au second alinéa de l’article R. 62, au service du casier judiciaire national automatisé, par lettre, télégramme, télécopie ou télétransmission, avec l’indication de l’état civil de la personne dont le bulletin est demandé, de la qualité de l’autorité requérante ainsi que du motif de la demande.

” Si la personne dont le bulletin est demandé est une personne morale, la demande doit comporter l’indication de sa dénomination, de son immatriculation au répertoire d’identification des entreprises et de son siège. Lorsque la personne morale n’est pas immatriculée, un justificatif de son identité doit être joint à l’appui de la demande. “
