I.-A prior declaration of an unpacking sale is sent by the organiser by registered letter with acknowledgement of receipt or delivered against receipt to the mayor of the commune in which the sale operation is planned, within the following deadlines:
1° Within the same timeframe as the application for authorisation to temporarily occupy the public domain and concomitantly with the latter when the sale is planned on the public domain and the mayor is the competent authority to issue the authorisation;
2° In other cases, at least fifteen days before the date scheduled for the start of this sale.
At least eight days before the start of the sale, the mayor shall inform the declarant that, because the duration of the sale authorised by the second paragraph of I of article L. 310-2, he is liable to the penalty provided for in 3° of article R. 310-19.
II.-These time limits do not apply to unpacking sales of fresh fruit and vegetables carried out during a period of economic crisis recorded pursuant to article L. 611-4 of the French Rural and Maritime Fishing Code, or in anticipation thereof, with the aim of promoting, through rapid destocking, the regularisation of market prices; these sales may be carried out without delay, by joint decision of the Minister responsible for trade and the Minister responsible for agriculture and this after consultation by the Minister responsible for agriculture with the relevant inter-trade organisation.
III.-An order of the Minister for Trade sets out the list of information contained in this declaration.
